Welcome to The Twelver Studios. The terms “we”, “us”, and “our” refer to The Twelver Studios. We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”) to provide you with a curated shopping experience.
The Twelver Studios is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when using our Services. Please read these Terms carefully, as they include important information about your legal rights, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your province or territory of residence.
You may be required to provide personal information such as your email address, billing, payment, and shipping details. You represent that all information provided is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Accounts may not be transferred, sold, or assigned to another person.
SECTION 2 – OUR PRODUCTS
We make every effort to accurately display and describe our products. However, product appearance, colour, texture, or finish may vary due to screen settings, materials, and the nature of handcrafted or engraved items.
All product descriptions, images, pricing, availability, and specifications are subject to change at any time without notice. We reserve the right to discontinue or limit quantities of any product.
Custom & Made-to-Order Items
Certain products offered by The Twelver Studios are custom-made or personalized based on customer specifications. Due to their nature:
- Custom-made items are final sale
- Orders cannot be cancelled, returned, or exchanged once production has begun
Customers are responsible for reviewing all personalization details, including spelling, dates, sizing, and design selections, before placing an order.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. The Twelver Studios reserves the right to accept or decline any order at its discretion. An order is not accepted until payment has been processed and confirmation has been issued.
Order Cancellations
Orders may be cancelled within 24 hours of purchase, provided production has not yet started.
For custom-made items, production may begin immediately after an order is placed. Once production has begun, orders cannot be cancelled, modified, or refunded.
Purchases are subject to our Refund Policy.
Damaged or Incorrect Items
If an item arrives damaged or incorrect, you must contact us within 48 hours of delivery, as shown by the carrier's tracking, with your order number and clear photos of the item and packaging. Keep the item and its packaging until we confirm. We will review each claim and get back to you with a decision. Claims submitted after 48 hours may not be eligible for review or resolution.
SECTION 4 – PRICES AND BILLING
All prices are listed in Canadian Dollars (CAD) unless otherwise stated.
Pricing may vary based on customer location, applicable taxes, duties, shipping costs, currency conversion, or regional pricing adjustments. Prices displayed at checkout are final before payment.
We reserve the right to change prices or discontinue products at any time without notice.
You agree to provide accurate and up-to-date billing and payment information and authorize us to charge your selected payment method.
SECTION 5 – SHIPPING AND DELIVERY
Shipping and delivery times are estimates only and are not guaranteed.
If there is an unexpected delay in production or shipping, we will reach out to you directly using the contact information provided at checkout.
We are not responsible for delays caused by shipping carriers, customs processing, supply chain issues, or events outside our control. Once an order is handed to the carrier, title and risk of loss pass to you.
We are not responsible for damage caused after delivery, improper handling, or normal wear and tear.
SECTION 6 – INTELLECTUAL PROPERTY
All content on this website, including but not limited to product designs, engravings, artwork, text, images, layouts, logos, and photographs, is the exclusive property of The Twelver Studios and is protected by applicable intellectual property laws.
Purchasing a product does not grant ownership, reproduction rights, or commercial usage rights to any design.
You may not copy, trace, reproduce, modify, distribute, create derivative works from, resell, or commercially exploit our designs or products without prior written authorization.
This section covers our own designs and content. Content you supply stays yours (see Custom Designs, Uploads and the Twelver Designer).
All rights not expressly granted are reserved.
SECTION 7 – RESELLERS & AUTHORIZATION
Our products and designs may not be resold, redistributed, or sold forward without explicit written authorization from The Twelver Studios.
If you are interested in becoming an official reseller, you must contact us directly for approval. Authorized reseller relationships require written authorization and may be subject to additional agreements, pricing structures, and conditions.
Business and corporate orders (for example, branded merchandise, client gifts, or internal use) are welcome and are not considered resale.
Unauthorized resale or duplication may result in legal action.
SECTION 8 – CUSTOM DESIGNS, UPLOADS AND THE TWELVER DESIGNER
Your content. When you upload a photo, logo or design, or enter text, you confirm that you own it or have permission to use it, and that engraving it won't infringe anyone's rights. You keep ownership of your content. You let us use it to make, check and support your order.
What we won't engrave. We may decline or cancel an order, with a full refund, if it includes content that is hateful, harassing or sexually explicit, or that uses someone else's trademark, logo or artwork without permission.
Previews. The Designer's preview is an illustration of how your piece will look. Real materials vary, and the finished mark depends on the material and the light. We engrave the design you approved. We may make small technical adjustments the laser needs, such as thickening very thin lines; if a change would visibly alter your design, we'll contact you first.
Library designs and fonts. Designs from our library and the fonts in the Designer are owned by us or licensed to us. Using them gives you the engraved piece, not the design files, and they can't be copied or resold.
Your files. How we keep and delete your order files is explained in our Privacy Policy.
Photos of finished work. We may photograph finished pieces for our gallery and social media. We hide names, dates and personal photos unless you agree, and we'll remove any photo on request.
SECTION 9 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available.” We are not responsible for any issues arising from their use. This includes the Twelver Designer; see Custom Designs, Uploads and the Twelver Designer.
SECTION 10 – THIRD-PARTY LINKS
Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. Accessing them is at your own risk.
SECTION 11 – RELATIONSHIP WITH SHOPIFY
The Twelver Studios is powered by Shopify. All purchases are made directly with The Twelver Studios. Shopify is not responsible for any aspect of sales, products, or services provided by us.
SECTION 12 – PRIVACY POLICY
All personal information collected through our Services is subject to our Privacy Policy and Shopify’s Privacy Policy.
SECTION 13 – FEEDBACK
Any feedback, reviews, or suggestions submitted grant us a perpetual, royalty-free, worldwide license to use such content for business and promotional purposes.
SECTION 14 – ERRORS, INACCURACIES, AND OMISSIONS
We reserve the right to correct errors or inaccuracies related to product descriptions, pricing, promotions, shipping charges, transit times, availability, or previews at any time without notice.
SECTION 15 – PROHIBITED USES
You may not use the Services for unlawful purposes, infringe intellectual property, harass others, transmit malicious code, scrape content, or misuse the Services in any way that may harm The Twelver Studios or others.
SECTION 16 – DISCLAIMER OF WARRANTIES
All products and Services are provided “as is” and “as available”, without warranties of any kind, except where prohibited by law.
This disclaimer does not apply to items damaged in transit and properly reported within the timeframe outlined in these Terms.
SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, The Twelver Studios shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid for the product.
SECTION 18 – INDEMNIFICATION
You agree to indemnify and hold harmless The Twelver Studios and its partners from any claims arising from your breach of these Terms or misuse of the Services.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
SECTION 20 – WAIVER & ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and The Twelver Studios and supersede all prior agreements.
SECTION 21 – ASSIGNMENT
You may not assign your rights under these Terms without written consent. We may assign our rights without restriction.
SECTION 22 – GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada.
SECTION 23 – HEADINGS
Headings are for convenience only and do not affect interpretation.
SECTION 24 – CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. Continued use of the Services constitutes acceptance of changes.
